Terms of Service

1. Acceptance of Terms

By accessing or using MyScrapbook Studio (“the Service”), operated by MyScrapbook Studio (“we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

MyScrapbook Studio is a browser-based digital scrapbooking platform that allows users to create, edit, and export scrapbook pages. The Service includes:

• A drag-and-drop scrapbook editor with photos, text, masks, and embellishments
• A Creator Marketplace where users can buy and sell digital scrapbook kits and elements
• Cloud storage for scrapbook projects (subject to plan limits)
• Export and download of completed scrapbook pages

3. Account Registration

• You must be at least 13 years old to create an account
• You are responsible for maintaining the security of your account credentials
• You must provide accurate and complete information during registration
• One account per person — multiple accounts may be suspended without notice
• You are responsible for all activity that occurs under your account

4. Subscription Plans and Billing

Free Plan

• Limited to 3 scrapbook projects
• Access to basic features and free marketplace content
• No credit card required

Paid Plans (Plus, Studio)

• Billed monthly or annually via Stripe
• Subscriptions auto-renew unless cancelled before the billing period ends
• You may cancel at any time — access continues until the end of the current billing period
• Refunds are handled on a case-by-case basis; contact memories@myscrapbookstudio.com

5. Creator Marketplace

For Buyers

• All marketplace purchases are final unless the product is materially defective or misrepresented
• Purchased content is licensed for personal use only — you may not resell, redistribute, or claim ownership of purchased assets
• Guest checkout is available for one-time purchases without creating an account

For Sellers (Creators)

• You must own or have proper licensing for all content you upload to the marketplace
• By listing content, you grant MyScrapbook Studio a non-exclusive license to display, distribute, and promote your products on the platform
• Revenue split: 70% to creator (75% for Elite creators), 30% (25%) platform fee
• Payouts are processed through Stripe Connect — you must complete Stripe onboarding to receive earnings
• We reserve the right to remove content that violates these terms or our content guidelines

6. Content and Intellectual Property

Your Content

You retain ownership of all scrapbook pages, photos, and creative work you produce using the Service. We do not claim any intellectual property rights over your content.

Our Content

The MyScrapbook Studio name, logo, interface design, and any free content provided by us remain our intellectual property. You may not copy, modify, or distribute our branding or proprietary materials.

Third-Party Content

You are responsible for ensuring you have the right to use any photos or materials you upload. Do not upload copyrighted content without permission.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is offensive, harmful, or infringes on others' rights
• Attempt to access other users' accounts or data
• Reverse-engineer, decompile, or interfere with the Service's operation
• Use automated tools to scrape content or overload the Service
• Upload or distribute malware, viruses, or other harmful software

8. Termination

• You may delete your account at any time through your account settings or by contacting support
• We may suspend or terminate accounts that violate these terms, with or without notice
• Upon termination, your scrapbook data will be permanently deleted within 30 days
• Marketplace sellers: pending earnings will be paid out according to the standard payout schedule before account closure

9. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available.” We make no warranties, express or implied, regarding the Service's reliability, availability, or fitness for a particular purpose.

To the maximum extent permitted by law, MyScrapbook Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, revenue, or content.

10. Indemnification

You agree to indemnify and hold harmless MyScrapbook Studio and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.

13. Governing Law

These terms are governed by the laws of New Zealand. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.
